On December 13, 2024, the Department of Labor released its Fall 2024 regulatory agenda, which includes rulemaking activity specific to the Occupational Safety & Health Administration (OSHA).

On December 13, 2024, the Department of Labor released its Fall 2024 regulatory agenda, which includes rulemaking activity specific to the Occupational Safety & Health Administration (OSHA). The regulatory agenda provides the regulated community with an idea of what the agency will be focusing on in the coming months. The Fall 2024 regulatory agenda contains no significant updates from its Spring 2024 regulatory agenda. Most updates are related to dates which proposals will be introduced. Specific to construction, OSHA intends to move forward with the following proposals:

• Amendments to the Cranes and Derricks in Construction Standard
• Welding in Construction Confined Spaces
• Heat Injury and Illness Prevention in Outdoor and Indoor Work Settings
• Infectious Diseases Standard

The regulatory agenda contains two proposals that will have an impact on construction that are significantly further along in the rulemaking process. Those include Personal Protective Equipment (PPE) in Construction and Heat Injury and Illness Prevention in Outdoor and Indoor Work Settings, which is referenced above. The PPE in Construction rulemaking was finalized on December 12, 2024 and goes into effect on January 13, 2025. The Heat Injury and Illness Prevention in Outdoor and Indoor Work Settings is currently available for public comment until January 14, 2025.
