FHWA Releases New Work Zone Safety Rule

On November 1, the Federal Highway Administration updated its Work Zone Safety and Mobility and Temporary Traffic Control Devices rule aimed at enhancing safety and mobility in highway work zones.

On November 1, 2024, the Federal Highway Administration (FHWA) updated its Work Zone Safety and Mobility and Temporary Traffic Control Devices rule aimed at enhancing safety and mobility in highway work zones. Changes address the increased need for accommodating vulnerable road users such as workers and pedestrians and considerations for new technologies that have emerged since the rule was last updated 20 years ago.

The most impactful update for contractors is the new requirement for positive protection devices, such as temporary concrete barriers, in work zones with high-speed traffic. These barriers are now mandated to safeguard workers during construction, utility, and maintenance operations. Exceptions can be made based on engineering studies, but this change will affect how work zones are established across the country.

The rule also clarifies that positive protection devices are eligible for project funding, allowing them to be added as pay items in bids. Over the coming months, FHWA will offer support materials and outreach to assist stakeholders in implementing these changes and improving work zone safety nationwide.

The final rule takes effect on December 2, 2024, while certain aspects give up to 24 months for stakeholders to comply. To read the final rule, click here, or to read AGC’s comments on the proposed rule, click here.
