On December 11, the U.S. Department of Labor announced that its Occupational Safety and Health Administration finalized a revision to the personal protective equipment standard for construction. 

On December 11, the U.S. Department of Labor announced that its Occupational Safety and Health Administration (OSHA) finalized a revision to the personal protective equipment standard for construction. The final rule updates the personal protective equipment (PPE) standard for construction (29 CFR 1926.95(c)) to explicitly require that PPE fit properly. This revision aligns the language in the PPE standard for construction with the corresponding language in OSHA’s PPE standards for general industry and shipyards. The rule will go into effect on January 13, 2025.

AGC is continuing to review the final rule and will provide a more detailed analysis upon completion. In the meantime, members are encouraged to review the comments submitted by AGC and its industry partners in response to the notice of proposed rulemaking, which raised significant concerns due to the ambiguity of the proposed language and lack of clarity surrounding compliance obligations and enforcement.
