The Department of Agriculture has proposed contract clauses that would essentially reinstate the Obama Administration’s Blacklisting Rule.
On March 21, AGC called on the Department of Agriculture to withdraw its proposed contract clauses that would essentially reinstate the Obama Administration’s Blacklisting Rule on contractors through that Department and its agencies’ procurements. In 2017, AGC worked with Congress to repeal the Blacklisting Rule using the Congressional Review Act (CRA). The CRA prohibits federal agencies from pursuing regulatory initiatives that are substantially similar to those that are repealed. If these contract clauses are finalized, AGC will review all options to reverse them.
